Amanda,

You bring up very good points.

I didn't sign anything formal with mine, but I was comfortable with that WITH HER. Other people? Maybe not as much.

Interestingly enough, I already had functional spec, just not the UI to display everything nicely and prettily. That's where I really needed a designer. But I do think that if the client has no clue, the designer may have to walk her through the process.

As a designer, I can say you bring up a lot of great points, but there is one more option to consider. When choosing a designer, do you want to go with a more formal type contract with a full-service web design company, or are you looking to establish a more personal, hands-on arrangement with your designer? Your choice all depends on what you hope to accomplish with your site. Will its purpose be mainly functional (conveying information), or are you looking to make a creative statement?

For instance, as a freelance designer, I work very casually, basing my fees and payment options on the individual job. If I hit it off with a potential client, I'm willing to work closely with them to create something completely unique that reflects both their needs (function) and personality (creativity). I encourage my clients to be involved in the design process, to push the envelope and go for something outside the box, and I love it when a client knows what they want and is willing to be patient and work with me as a partner to get it right. Your website is your calling card, so you should never settle for something that isn't reflective of who and what you are.

Thanks, Nadia. I actually tweaked my <a href="http://www.getelle.com/services/terms-of-service/" target="new" rel="nofollow">terms of service</a> to clarify a few of the things you mentioned here. :D

I think filling out the design questionnaire is probably the most important thing you can do. It's really hard to know what's actually involved in "I want a red website." And talk to your designer... the more you talk and ask, the fewer surprises there will be at the end. If my clients aren't deliriously happy when their site goes live, then I haven't done my job right.
